AGREEMENT TO TERMS

The Amateur Esports Union may update or modify these terms from time to time, so please make sure you review them regularly. USER GENERATED CONTRIBUTIONS

The Amateur Esports Union Website may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality, and may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to the Amateur Esports Union or on the Website, including but not limited to text, writings, video, live streams, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, “Contributions”). You have the written consent, release, and/or permission of each and every identifiable individual person in your Contributions to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Website and these Terms of Use. Your Contributions are not false, inaccurate, or misleading. Your Contributions are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation. Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable (as determined by the Amateur Esports Union). Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone. Your Contributions are not used to harass or threaten (in the legal sense of those terms) any other person and to promote violence against a specific person or class of people. Your Contributions do not violate any applicable law, regulation, or rule. Your Contributions do not violate the privacy or publicity rights of any third party. Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors. Your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap. Your Contributions do not otherwise violate, or link to material that violates, any provision of these Terms of Use, or any applicable law or regulation. Any use of the Website in violation of the foregoing violates these Terms of Use and may result in, among other things, termination or suspension of your rights to use the Website.

CONTRIBUTION LICENSE

The Amateur Esports Union’s website may offer you opportunities to engage in various forms of online communication and participation, such as blogs, forums, interviews, and message boards. You may create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials, including but not limited to text, images, audio, video, comments, and personal information (collectively referred to as “User Generated Content” or “UGC”). Other users of the website, as well as third-party websites, may have access to your UGC, and therefore it cannot be considered confidential or proprietary.
By submitting UGC, you represent and warrant that:

  • You are the rightful owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize the Amateur Esports Union, the Website, and other users of the Website to use your UGC in any manner contemplated by the Website and these Terms of Use.

  • Your UGC does not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors.
  • Your UGC does not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap.
  • Your UGC does not otherwise violate, or link to material that violates, any provision of these Terms of Use, or any applicable law or regulation.
    Any violation of the above terms by submitting UGC will result in a violation of these Terms of Use and may lead to termination or suspension of your rights to use the website.

SOCIAL MEDIA

As part of the Website’s features, you may have the option to link your account with certain third-party service providers through online accounts you have with them (each called a “Third-Party Account”). This can be done by providing your Third-Party Account login information through the Website or by granting the Amateur Esports Union access to your Third-Party Account, in accordance with the terms and conditions that govern your use of each Third-Party Account. The Amateur Esports Union may access your email address book associated with a Third-Party Account and your contacts list stored on your mobile device or tablet computer solely for purposes of identifying and informing you of those contacts who have also registered to use the Website. You have the option to deactivate the connection between the Website and your Third-Party Account at any time, either by contacting the Amateur Esports Union or through your account settings (if applicable). The Amateur Esports Union will attempt to delete any information stored on its servers that was obtained through such Third-Party Account, except the username and profile picture that become associated with your account.

SUBMISSIONS

Participants’ email and gaming information will be used for communication regarding the tournaments, stat tracking, and clip contests, as well as any other related purposes.

Participants’ submitted clips or streams may be used in promotional materials and broadcasts related to the tournaments and clip contests.

The Amateur Esports Union will not share participants’ personal information with any third parties without explicit consent.

Participants can request the removal of their personal information or submitted content from our records by contacting the Amateur Esports Union via email.
The Amateur Esports Union takes data privacy and security seriously. By using our website, you agree to our Privacy Policy, which is part of our Terms of Use. GOVERNING LAW

DISPUTE RESOLUTION

The Amateur Esports Union believes that most conflicts can be resolved amicably and inexpensively. Arbitration can be conducted in person, via submission of documents, by phone, or online. The arbitrator will make a written decision, but is not required to provide a statement of reasons unless requested by either party. The arbitrator must comply with applicable law, and any award may be challenged if the arbitrator fails to do so. Unless otherwise stated by the applicable AAA rules or applicable law, the arbitration will take place in Los Angeles County, California. Parties may litigate in court to compel arbitration, stay proceedings pending arbitration, or to confirm, modify, vacate, or enter judgment on the award entered by the arbitrator.
If, for any reason, a dispute proceeds in court rather than arbitration, the dispute shall be commenced or prosecuted in the state and federal courts located in Los Angeles County, California, and both parties hereby consent to, and waive all defenses for lack of personal jurisdiction and forum non convenes with respect to venue and jurisdiction in such state and federal courts. The United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transaction Act (UCITA) do not apply to these Terms of Use.
Both parties agree that any arbitration will be limited to the dispute between the parties individually. To the fullest extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
No dispute related to the Amateur Esports Union’s website may be commenced more than one year after the cause of action arose. If any provision of this agreement is found to be illegal or unenforceable, neither party will elect to arbitrate any dispute falling within that portion of the provision found to be illegal or unenforceable, and such dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and both parties agree to submit to the personal jurisdiction of that court.
